1. Who We Are

misplay.fun is operated by the misplay.fun team. In these Terms, "misplay.fun", "we", "us" and "our" mean the team responsible for the website, app and related services.

2. Accepting These Terms

You accept these Terms when you access the website, install or use the app, create an account, join an event, create an event or otherwise use misplay.fun. If you use misplay.fun for a group, club, organization or other entity, you confirm that you have authority to accept these Terms for that entity.

If you do not agree with these Terms, do not use misplay.fun.

3. Eligibility

You may use misplay.fun only if you are at least 16 years old and legally able to enter into these Terms. If local law requires a higher age to use online services or participate in sports events, that higher age applies.

You are responsible for making sure that your use of misplay.fun and participation in any activity is allowed under the laws and rules that apply to you.

4. Accounts

Some features may require an account. You agree to provide accurate information, keep your account details up to date and protect your login credentials. You are responsible for activity that happens through your account unless the activity was caused by our failure to use reasonable security measures.

Tell us promptly if you believe your account has been accessed without permission.

5. Using misplay.fun

misplay.fun helps people discover sports activities, create or join events, find venues, coordinate with groups and connect with people who want to play. Features may vary by country, city, platform, account type or release stage.

We may update, add, limit, rename or remove features as the service evolves. We do not guarantee that a specific event, venue, group, participant, rating, recommendation or app feature will always be available.

6. Events, Venues and Offline Activities

Events and venue information may be created by users, organizers, communities, venues or third-party services. Unless we clearly say otherwise, misplay.fun does not own, operate or control the venues, games, coaches, organizers or offline activities shown in the service.

You are responsible for checking event details, venue rules, availability, prices, booking conditions, equipment needs, weather, safety conditions and the suitability of an activity for you before you attend.

Sports and social activities involve real-world risks. You are responsible for your own health, fitness, conduct, equipment and decisions. Stop participating if an activity feels unsafe and follow applicable venue rules, organizer instructions and local law.

7. User Content

You may be able to submit profile information, event details, group content, comments, ratings, messages, photos, venue suggestions or other content. You keep ownership of your content, but you grant misplay.fun a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt and use that content as needed to operate, improve and promote the service.

You confirm that you have the rights needed to submit your content and that your content does not violate law, these Terms or the rights of others. We may remove, hide or limit content where we reasonably believe it violates these Terms, creates risk or harms the service experience.

8. Community Rules

misplay.fun is built for real people making real plans. You agree not to:

• harass, threaten, stalk, bully, abuse, exploit or intimidate another person;
• post illegal, hateful, violent, sexually explicit, deceptive or harmful content;
• create or promote unsafe, fraudulent, discriminatory or unlawful events;
• impersonate another person, venue, organizer, brand or organization;
• spam users, scrape data, automate access or interfere with the service;
• attempt to bypass security, moderation, access limits or account restrictions;
• use misplay.fun in a way that violates applicable law or third-party rights.

We may review reports, moderate content, restrict visibility, block accounts, suspend access or remove users where appropriate. Where in-app reporting or blocking tools are available, use them to report objectionable content or behavior.

9. Third-Party Services

misplay.fun may link to or integrate third-party services such as Google Maps Platform, Apple App Store, Google Play, hosting providers, analytics providers, diagnostics tools, venue websites, booking systems or payment providers. These services may have their own terms and privacy policies.

We are not responsible for third-party services, venue websites, external content, external payments or information provided by third parties. Use them at your own risk and review their terms before relying on them.

10. App License

The misplay.fun app is licensed, not sold. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive and non-transferable license to install and use the app on devices you own or control for your own lawful use.

You may not copy, rent, sell, transfer, sublicense, modify, reverse engineer, decompile, disassemble or attempt to derive the source code of the app except where applicable law allows it despite this restriction.

If you download the app from Apple App Store or Google Play, the store's rules may also apply to your use of the app, purchases, refunds, updates and account relationship with that store.

11. Fees and Purchases

Some features may be free and others may become paid. If we offer paid features, we will show the relevant price and payment terms before purchase. App store purchases, refunds and billing issues may be handled by Apple App Store or Google Play under their own rules.

Venue bookings, court fees, organizer fees, equipment rental, coaching fees or other offline costs may be charged by third parties. Unless we clearly say otherwise, those charges are between you and the relevant third party.

12. Intellectual Property

misplay.fun, Nekko, the logo, visual assets, product design, software, text and other materials in the service are owned by us or our licensors and are protected by intellectual property laws.

These Terms do not give you ownership of the service or permission to use our brand, logos, characters, artwork or other protected materials except as needed to use misplay.fun normally.

13. Privacy

Our Privacy Policy explains how we collect, use and protect personal data. By using misplay.fun, you acknowledge that we process data as described in the Privacy Policy.

14. Availability and Changes

We work to keep misplay.fun useful and reliable, but the service may be interrupted, delayed, unavailable, changed or discontinued. We may perform maintenance, release updates or limit access for security, legal, operational or product reasons.

Some features may be experimental, beta or available only to selected users.

15. Disclaimers

To the fullest extent permitted by law, misplay.fun is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, secure, accurate or suitable for your specific needs.

Recommendations, ratings, venue details, event details, availability and location information are provided for convenience and may be incomplete or outdated. Always verify important information before relying on it.

misplay.fun does not provide medical, fitness, safety, legal, financial or professional advice.

16. Limitation of Liability

To the fullest extent permitted by law, misplay.fun will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, goodwill, opportunities or business.

To the fullest extent permitted by law, our total liability for claims related to misplay.fun is limited to the greater of the amount you paid us for the service in the 12 months before the claim or EUR 50. Nothing in these Terms limits liability that cannot be limited by law.

17. Your Responsibility to Us

If you use misplay.fun on behalf of a business, club, organizer, venue, community or other entity, that entity agrees to defend and indemnify misplay.fun from claims, losses, damages, liabilities and expenses arising from your content, events, misuse of the service or violation of these Terms.

For individual consumers, this responsibility applies only to the extent permitted by applicable law.

18. Suspension and Termination

You may stop using misplay.fun at any time. We may suspend or terminate access, remove content or restrict features if we reasonably believe that you violated these Terms, created risk, harmed other users, infringed rights, violated law or misused the service.

Sections that by their nature should survive termination will continue to apply, including intellectual property, disclaimers, limitation of liability, responsibility to us and dispute terms.

19. Changes to These Terms

We may update these Terms as the service changes. When we make material changes, we will update the date above and, where appropriate, provide additional notice. Your continued use of misplay.fun after updated Terms take effect means you accept the updated Terms.

20. Governing Law and Disputes

These Terms are governed by the laws applicable to the operator of misplay.fun, without excluding any mandatory consumer protection rights that apply where you live.

If you are a consumer in the European Union, European Economic Area, United Kingdom or another region with mandatory local consumer rights, you keep those rights. We encourage you to contact us first so we can try to resolve any issue informally.
